writes:I have been desperately trying to get a divorce from my husband whom I haven't been with for 18 yrs now. At first I tried to have him served with the papers, but was unseccessful when he moved. He eventually had me served at my job. I thought that in 6mos. or so we would have this thing done. My Mom got sick and the Dr. gave her 6 mos., I had his sister tell him, and asked that he please resolve this before she passed. I have been with my fiance for 10 yrs, and because my family is very religious, he wasn't ever able to really bond with her. I thought that since she was dying, that my husband [ughh!] would take the neccessary steps to finalize the divorce. He didn't. Does anyone in the state of CA have any advice as to wht I could do next? I can't affod an Attorney, so that's out. HELP!

One more thought is to check with local law schools; they often have clinics provided by law students. Worth a try.

rorowes is verified as being by the original poster of the question I would have to get an Attorney, but I can't afford one. Since he served me, it his case, and I would have to petition the courts to take it over. It's a mess.

I would look at the link Tisha provided. However, I think you've been married too long to file without an attorney and if you have any debts or kids or if he has retirement or assets, you'd be crazy not to get an attorney. Some may let you pay after the case is resolved but I would check both options. I've heard of online divorce kits that are pretty cheap as well, but I think you have to only be married a couple of years. If you have no money, see if you can get some sort of public assistance on this.
