This is a legal question that needs to be answered by somebody trained in the legal field. I know that it varies from state to state. Whether the boy or the girl is older, and by how much, is sometimes a factor. In some instances the case law of court rulings may be different than the statute law recorded in the legal code.
Most state Bar Associations sponsor some kind of "Ask the Lawyer" service where relatively straightforward questions (like yours) can be answered for free, or at very little cost.

 It depend on what state your are in, most of them are 18 so therefore they would be sleeping with someone underage, however in some states it is 16. xx
