Caught wearing my clothes and now due in court, what will happen to him?

my partner dressed up in my clothes one night and went outside for a cigarette. he has since been done with public indecency with intent of fear and alarm. this was simply not true. and is due in court in a couple of months. he went out a bit further than usual as he heard something. he came back in and next thing a policeman was shining a torch in my face and he got arrested. the point is his genitals were not on show as he had them taped up.

what will happen to him, we are both worried.

thanks for all the info.

he didnt see a duty solicitor, he got one at court and she cant find anything in the law. the fact that his genitals were covered and nothing to show, we are not worried by that. the cop said he was running on the road firstly its a narrow road, if he did that he be instantly killed plus he had shoes that were hurting him, i cant see him running in them. the other witness said he was posing,that morning car windows was frozen up and her window wasnt exactly clear so how could she see? i was never told by the police he was actually charged with anything and he wasnt actually arrested only cautioned. the public area i meant was the front of our garden, he heard something and went out a bit further than he normally does ie into the garden. he normally stands in the close for a cigarette. has one and comes in takes everything off and comes to bed.

no harm in that surely?

Mushgirl agony auntJesus Christ. What a narrow-minded cop. If the guy had nothing on show, why are they bothering exactly? I know guys who go out on the town dressed as women and as far as I know, it ain't illegal! How much was he wearing? If it was just underwear then maybe that's why they got narked, I guess it's counted as indecent exposure if any adult goes around publicly dressed in just their undies. Oh well, I guess it'll be a good talking point in the future...

WizardOfWaz agony auntThe law of public decency is sometimes quoted as; "offending against recognised standards of propriety at the lower end of the scale". And is often legaly based on these "recognised standards" being judged on the basis of where you are and what is generally acceptable for that particular situation.

So if you flash your arse when you come staggering out a night club at 3am amongst hundred of other boistorous clubbers at best the plod will just ignore you, or at worst warn you to behave. However if you do the same thing in broad daylight in a kiddies play park you could get nicked, even if it was just intended for a private laugh with your mates.

Your partner cannot be charged with any offence simply for the type of clothing he was wearing the provisio being his behaviour was otherwise normal.

The charges suggest that either there had been a complaint against him or he had been behaving in manner that might cause alarm. The story that he went out for a ciggie and "went a bit further then usual" does not shed any light on why he was in a public area, and what he was doing there that attracted the attention of the local flatfoot.

No one gets charged with "intent" for cross-dressing, indeceny maybe, but only under extremely rare circumstances, but intent suggests inapropiate behaviour regardless of whether the suspect is wearing fancy clothes.

Time your lad came clean.

LazyGuy agony auntSeems a bit odd, the UK is a bit more backwards then mainland europe but it ain't the US. Exactly what was he wearing and doing to get a cop on his case AND to get charged?

The police on the whole is pretty tolerant of odd behaviour, they seen it all and usually just let people go with a warning. Unless they are lying. Then they throw the book at you.

Suggest to your boyfriend he tell you EXACTLY what he was doing that A. caused the police the be called (unlikely for a police man just to pass by at night and B. caused the police officer to do more then just snigger at seeing him in your undies.

I suspect he was doing more then just having a smoke in female underwear in your own garden. It might be wise to find this out now and not in court.

But as always in this kind of case, GET A LAWYER!

TELLULAH agony auntI really cant believe he got into trouble for wearing your clothes. Couldnt you have said it was just a joke and you were both mucking about?

Do they really put men away for dressing up in womens clothes in America? seems a bit strange and you would think the police would have better things to do, on both sides of the water. Dont worry I'm sure it will be ok.

Your post did make me laugh though. I have a friend who is a Mistress, and one of her customers is a Judge that likes being beaten, tied up and having weight's tied to his genitals, then she makes him run accross the room. This is totally true.

Are you sure he didnt get into trouble for smoking in a band area. Thats the sort of thing that would happen in Britain.

Ask oldersister agony auntThere has to be more to this story if your boyfriend took the time to tape his genitals up so he could wear your clothes. Wouldn't it have just been easier to put his own clothes on? Sounds like a lot of work to "just be going out for a smoke".

Strange behavior should be kept behind closed doors, not displayed in public. What was he thinking? Without thinking before acting, I'm sure he will given possibly a fine and maybe even jail time. If your lucky and can explain the stupid behavior, he might get probation.

He should think before he acts: simple enough.

You are from the UK so I know the law is pretty ok with people dressing up as a woman.

What did your duty solicitor say when he was at the station?

Get yourself a solicitor and you should be ok. They are not going to put him in prison as the prisons are full so they only lock up people who are a risk to the public.

Go and be a witness for him, and you should be fine.

I am surprised he got charged if it was just a misunderstanding.
