Question - (2 January 2007) 2 Answers - (Newest, 2 January 2007)
A male United Kingdom, anonymous writes:

A friend of mine is not married, but has a child. Him and his partner split up and the child lives with the mother. He has no parental responsibility for his daughter. How would he go about getting it without having to take her to court? She is unwilling to visit the solicitor to arrange it. Can he visit the solicitors for a form for her to sign or anything like that?

Can somebody please explain how this could be solved without it being dragged through the courts?

Thanks in advance.

willywombat agony auntIn the UK he can go to a solicitor to arrange 'parental rights'. This has to be done with the consent of the Mother of the child though in cases where they are not married.

If the mother does not want to give consent the only way forward is through the courts, although this is not the best way to go for anybody - stress and upset often being primary features of this route.

Tell him good luck.

eyeswideopen agony auntSorry but it will have to be brought before a judge in order for it to be legal. He can do it with or without the mother's cooperation. Custody of a child, visitation rights, etc. all have to be decided by a judge. Now if he is on good terms with the mother maybe they can work something out between them but it would have no legality.
