Question - (5 October 2010) 5 Answers - (Newest, 12 October 2010)
A female United States age 30-35, anonymous writes:

Okay so I am "seeing" a man who just turned 29 and I am about to be 19, I am legal now but I have a problem. My aunt and a few other relatives have a problem with me seeing him and theyre against it. I had sex with him when i was almost 16 and he was 24, they bring this up and say he can still go to jail for what happened a few years ago.

Is this true?

A female reader, sweetlove United States +, writes (12 October 2010):

sweetlove agony auntThis is not true. He cant go to jail unless you want him to go. If you were still 16 or 17 then yes, But you are over 18 and like you said your legal now, You would have to be the one to say something, your aunt and family are out of say now.

No he cant go to jail for that. They would have to prove it. Is it recorded? If not then its a NO. Most laws needs a victim and I don't see one here and I doubt you would say You two had sex in the first place.

aunt honesty agony auntYes am afraid that it is, all you can do is hope that your family dont tell the law and if they do the both of you could always deny it. You are an adult now and are entitled to your own life, if he never forced himself on you and you were willing then dont worry about it

A male reader, ScottsCove United States +, writes (6 October 2010):

ScottsCove agony auntVaries by state. Pay the $100 and call a lawyer. Probably subject to either a 7 or 11 year statute of limitations. Once you're 18 you might be able to sign a statement that you don't hold him criminally liable for the underage sex. Were their witnesses ? How could they prove anything ?

If you eloped to Vegas, got married and legal, and your family, i.e. your parents, had their cousin Buford in the District Attorneys office file charges they probably wouldn't stick since you could go on TV and say how much you were "In Love" just wanted to live your lives and be left alone, The District Attorney, Judges and recalcitrant family members would look like idiots.

It's usually a bad Idea to marry someone your family hates, unless you come from a family of criminals that you plan to disassociate from for ever.

It's a long life and all those holidays and family get-togethers would be either non-existent for you or uncomfortable that some painful ugly thing might happen.

Give it a little longer, get some job training or further education, it will come in handy later on ... unless he's rich beyond imagining ... then get a big city lawyer to write your pre-nupital agreement for a big payout if it doesn't work out, Ivanna only got a measly $25 million, you should get double. A million isn't what it used to be.
