fairytail is verified as being by the original poster of the question thanks for all your replies Im really not concerned if this ex has or has not done anything. Its over anyways but He made it sound like if I cant have you might as well have someone else... I say more power to him I have washed my hands of him...

 According to surveys, a common (perhaps THE common, depending on the survey) view is that it becomes cheating when they kiss. So if they had sex or kissed at all (barring a peck on the cheek perhaps), it's cheating, yes.
