Day 9 is certainly in the fertile range so higher risk that at other points in your cycle. Logic being that as you say, sperm can live inside you for max 5 day and if your cycle is regular and 28 days you may ovulate on day 14. Also, ovulation isn't an exact science and may occur slightly earlier or later.
That said, even if you have sex on your most fertile day, pregnancy is never certain! Just ask all those who are trying to conceive!!
My partner and I are careful people but we always avoid unprotected sex between day 7 and day 20 of her cycle. We have enjoyed it at other times without a pregnancy resulting (however just remember that's not to recommend you have unprotected sex - it's an adult choice we both decide to make to take some risks sometimes)

Im going from memory here, but If I remember corectly, your MOST fertile days are between 10 and 14 days, so yes day 9 would be a pretty fertile time.
