Custody while having an absent parent?

A female United States age 41-50, *HREN1 writes:

hi, i live in ohio. my son's father has not seen him since 3-26-06. the last time he saw him he took him to his house instead of to the bowling alley where he said he was going(i let his girlfriend, now his wife pick him up) when i sent my sister to their house to pick up my son, (i was working) he called his girlfriend out to fight with her...they pressed charges on my sister for tresspass but never showed up for court. i have not heard a word since 11-06 and since have married a wonderful man that would like to adopt my son. i found out that he was in arkansas and that he had a warrant in medina county so i found out where he was bowling in arkansas and called the cops and they brought him back here. he is now living in cardington ohio with his wife and still no contact. how do i get his rights terminated so that the father that he knows and loves can adopt him? he owes my son over $14,500.00 and never paid a penny, while taking care of his wifes children, and keeping contact with one of his other 2 children here in ohio. my husband has 7 chidren with his ex wife and takes care of all of them. my ex. went to child support court for his other 2 kids but never for mine. even if there is nothing i can do about the child support or the custody, isn't there a way to take all my exs rights away? my son was 3 when he left and don't know who he is if we show a picture of him, now he is 6 and afraid that he will kidnap him(i never told him anything like that). please help me!!

Yep, definetly talk to a lawyer. I believe it is called abandondment if the Ex is not in the picture for so long. I believe you have a pretty good chance to terminate his rights if he has not shown any contact or support for the child in the last 3 years. Check with your state laws to see how long it is before you can consider it abandonment.
