Child support situation...

Im am in the military and when i enlisted I have told my recruiter that I have children. I only told him that i have two since there are the only daughters that were born in the U.S. He has told me just not to say anything about them and just get in the military, so i did. Now she is trying to get me for child support for all four of my daughters? Since i havnt told the military about my children would i be in some sort of trouble? Also i am married to my wife who lives with me and she has a 2 year old son. who lives with us. Now i Know she recieves family allowance and Welfare for all four of my children. So can she get me for child support from Canada to a U.S. servicemen? also if she does get me for child support how much would i be paying to her? since i do pay rent and provide for my wife and step son...also can someone tell me how much family allowance she is entitled to for all four of my daughters? and the Welfare?....oh and she also recieves 200 a month from another source of income! but can someone help me please...i am so confused and dont know what to do...thanks Alot any help is greatly appreciated!!!

Honest Answer agony auntOk, heres the deal. If you were never married to the previous woman and you are only on one of the childrens birth certificate, the Army will not recognize the children as yours. You will have to prove paternity in order to add the other daughters to your Defense Enrolling Ellegibility System (DEERS). The ex will not be able to prove that you are the father without court ordered paternity. The only child you will be responsible for is the one daughter (your name on the birth certificate).

You asked "also if she does get me for child support how much would i be paying to her?" The courts decide how much child support will be paid. If and when she takes you to court, it will be in your best intrest to go to court in Canada (or atleast hire an attorney to attend in your absence) to prove what you make per month. Your ex will go to court and tell them anything in order to the most amount of money from you. She is unlikey to to reveal "oh and she also recieves 200 a month from another source of income!" She will pin as much income on you while deflecting the amount she makes. If you want a voice in the court order child support you need to go to the child support hearing if and when one takes place.

Yes she can. Child support is a big deal and the United States will likely uphold a Canadian Child Support Order.

okay...thanka alot...yea i am married but NOT to my daughters mom. i have a wife and step son to support. um, I dont know what you mean by "when she goes to court alone" and im am only on one of my childrens birth certificate.

My father was military and for three children it was about 300 a month.... There are four of us, but I didn't count anyway being of age. I'm not really sure how much that helps, though. Taudl.

Honest Answer agony auntHere you go. I am a Soldier in the Army (19 yrs). You will not be in trouble with the military when you disclose that you have 4 children instead of 2. But here is what you need to do. Inorder to register the kids in DEERS (Id Card) you need a marriage certificate and divorce certificate before you enroll your children. If you were not married, the birth certificate must indicate that you are their father.

Are you remarried?

If you are not remarried, you are entitled to BAH Differencial. This is a monthly allotment designed to help pay child support.

If you are married, you are only entitled to BAH with dependents.

Now, you asked about child support. Child support is court ordered support that is dependent on your income and your exs income. In the eyes of the court, both are responsible for the raising of these children. It is based on both of your incomes. This is a court appearence that you need to attend so that the court knows exactly how much you are making and how much the ex in making. If she goes to court alone, you might end up on the short end of the stick.

You made these kids, and you need to support them. By adding them to DEERS and Tricare, you will be giving them many no cost to you benefits. Like medical coverage and use of the base facilities.

What you need to do is go to your units S1 office (PAC) and start getting the ball rolling. There are many benefits (no cost to you) that are out there for your kids. Take advantage of these.
