A female South Africa age 51-59, anonymous writes:

I have been living with a man for 10 years, he was separated from his wife 3 years before me, the family was informed about us, i worked with him in his business, he had kids and i never had kids, he died, he did not leave a will, what are my rights, and how do i go about to start asking for my rights??

Go to legal aid or to any court official. You are deemed his common law wife and you can approach the courts for assistance BUT dying intestate makes things more complicated. Did he have any pension/ provident fund ? Who was the beneficiaries? Any insurance policies? Who are the beneficiaries? Is his 'wife' still alive. She may be entitled to a childs share as well. His kids will definately inherit.how much of assets did he have? Any property? You also need to make an appointment with an attorney or a broker (financial adviser) for assistance.

TimmD agony auntAgreed, you need a lawyer first and foremost. If you were here in the US, I'd say the only rights you have are what the ex-wife and kids SAY you have. If you can prove that you've been living together for 10 years, that may give you a little bit of help.... maybe.

This is a good legal question for an attorney with a license to practice in the same venue you lived with your man. There should be large scale and local laws that protect you and define your rights.

You need a lawyer really. But the court will take his kids into account first and foremost. That means that his ex wife can be sure to get a chunk. But you need a lawyer.

babymama99 agony auntIf he had a legally wed wife (separated or not) then it would seem that she would have some say in that happens to his estate. Also the kids will play a big role being the next of kin if the wife is proven to be ineligible for some reason.

You should get a lawyer and talk to her/him about what your rights, if any, may be as his companion for all those years.
