Can we file a lawsuit against her on my behalf because there is a threat also to me that she may do something bad when Im out of the house.

Sweet-thing agony auntI don't know if you can or not, but there must be a legal agency who will know the answer. What you can do is change all your phone numbers; close your e-mail account and open a new one, cut off all avenues she is using to harrass you and if possible go ahead and file a restraint to prevent her from doing other things.

If you take all those emails and pictures and the threat, you'll be able to file charges.

Honeypie agony auntYou should be able to file a restraining order against her as well, and BRING all the nasty emails & pictures she sent you. You guys may also consider relocating... Might make life a ton easier.
