How do I quit this terrible job? And should I report the company after I'm gone?

How do I quit my job?

I work at a very busy yet understaffed restaurant. It's run the traditional east Asian way... I'm sorry for the poor terminology. What I'm trying to say is that they're very cheap. Mangement takes some of our tip, they didn't pay us for our "trainee" days and we work for six hours straight. No break, no standing, no sitting down even for a minute. Apparently because the boss watches the security cameras all day. I know the law is that they have to pay you an additional hour if they don't give you a 10 min break per every 4 hours. We always go overtime without pay and they're very unreasonable about many things. There are many problems with this small five-store establishment including firing people for no good reason. They haven't fired me because I'm one of the "needed" workers but not saying they won't.

Anyway I received a promising new job offering and I want to leave this job if when I get my new schedule. I'm planning to tell my manager - I'm quitting but I can stay until (date of next schedule change) if you still need me, otherwise I'l just pick up my paycheck next time. When he asks why I will just say that the hours are long, late, and always overtime. If he becomes disrespectful which I wouldn't be surprised about, I will just mention that they didn't pay me for trainee days and all those days they illegally didn't let us take a break. Hopefully I won't need to though. Does anyone have a better plan? I know it should be an easy process but this company is simply... Screwed up to say the least.

Also, should I report the above? I think it's the EEOC but I'm not sure what it's called. An organization for employee equality. If anyone has information and advice, I would LOVE to know. It would also benefit my former coworkers who were wrongfully terminated. Also, should I report it only if they are rude to me? Or should I report it even if I quit peacefully? Thank you!

So_Very_Confused agony auntyep you give two weeks notice... and don't worry.

ad for reporting it, don't burn bridges.... karma is ugly and they will get theirs when the time is right...

if they ask why you are leaving, you can say that the working conditions did not meet your needs...

Usually stuff that gets reported is a slow process and you'll have to be involved likely if it goes further. Probably would be the right thing to do if you have a clear case but a headache could be involved.

As for the quitting part, it's probably everyone's dream to storm out like a bad ass from a job they don't like. I've been taught though to never burn bridges, you never know what could happen. If he gets rude just be polite and professional about it as you can, then never put them on your resume cause they might say rude things about you.

Don't tell them anything. Just report it to your state's department of labor and they will investigate it. If you want to go as far as to sue, you can for overtime wages owed as well as being forced to work with no breaks. As Cally mentioned, it's hard to state your case if you've never asked for a break and they told you "no." Don't worry about telling them first, you don't owe them anything--besides, it's better for them to get caught when they don't suspect it.

Yes I'm in California but I didn't know about the 10 minute permitted rest period until recently. If I did then I would have asked for it. However it would have been difficult to ask anyway with it being SO busy, it probably would just upset the manager. Many times however when I just stood there to take a break they will tell me to work. Even mindlessly pretending to clean something!

I think you should report all of what you said after you leave, this is none sense no breaks, where I live in wisconsin we can contact the News Cast like TV6, Fox 6 or channel 12. I would start with the TV News Station because they will go there and investigate or maybe they can tell you who to go to. I would also look in the telephone directory and call a couple of attorneys and see what they have to say. This guy needs to be reported. Whatever you do remain anonymous and do not let anyone know what you're doing, not even your friends that works there.

Just say the truth. You quit because you find another job that give you more money and benefits. Simply like that. Give two weeks notice right now. Nothing wrong with that.

If you are in California, the paid 10 minute break after 4 hours of work is permitted, but if you don't ask to take the 10 minute break, it doesn't count against your employer. If you ask and it isn't granted, then you may have a case.
